Man with Alibi Still Being Accused by the NYPD
A man accused of firing at police is cleared of all charges after cell phone records and video show he was miles away from the gunfire, but police still insist he was the shooter.
January 05, 2011 /24-7PressRelease/ -- New York civil rights violation attorneys at The Perecman Firm is following the story of Shane Rhooms, who spent three weeks in Rikers for allegedly shooting at police officers.
Astoundingly, the NYPD insisted that Rhooms was the shooter even through video and cell phone records showed he was attending a concert in Manhattan's East Village when the Flatbush, Brooklyn shooting took place. Alarming to some New York civil rights violation attorneys, New York police continued to insist that Rhooms was the shooter even after he was cleared of all charges by a judge.
"Incredibly, even after being presented with positive proof that Rhooms couldn't have been where police say he was, he is still being accused of a crime that occurred in Brooklyn, far from where he was on East 11th Street, Manhattan, New York," civil rights violation attorney David Percman said.
The New York Daily News looked into the police who identified Rhooms as the shooter and what they discovered was, Lt. Robert Henderson has cost New York City more than $500,000 in court settlements. Since 2001, Henderson has been sued in Brooklyn and Manhattan federal courts, accused of false arrest in New York, illegal search and seizure, abuse of authority, and other possible constitutional violations. Most of the suits resulted in settlements ranging from $10,000 to $225,000.
Sometimes a solid basis of a suit against an employer, such as the City of New York, is that they allowed the person, here a police officer, to remain in their employ, despite the fact that they have evidence of the fact that they have a propensity to act outside the proper scope of their job and authority. In other words, they did it before and you put them back on the job to do it again.
False arrests can result in serious consequences for the victim. If Rhooms had been convicted of the crime he was accused of, he would have faced 45 years in prison.
New York civil rights violation attorneys also understand that Rhooms passed a lie detector test.
"The false arrest of Rhooms looks like a case of mistaken identity by the NYPD and that was bad enough, but then insisting that he committed the crime even after being confronted with solid evidence that proves otherwise exceeds all possible bounds of decency in New York," civil rights violation attorney Perecman said. "Such claims undermine the court system and this is being done by officers who are trusted to uphold the law."
